Couples embarking on Marriage or a Civil Partnership do not like to think it might end in failure, but sadly many relationships will irretrievably break down. A Pre-Nuptial agreement is a common sense step you should take to protect your personal and business assets, should you eventually divorce. |

A Pre-Nuptial agreement is an individually tailored agreement for parties who are about to marry or enter into a Civil Partnership. This may in fact be a second Marriage. When entering into Pre-Nuptial agreements it is very important that both parties take independent advice (from separate solicitors). |

Pre-Nuptial agreements are not currently considered to be legally binding but after the landmark case of Radmacher v Granatino 2010 there is now a presumption with the Courts in England and Wales that the agreement should be upheld providing the following applies; |
- Each party has had the benefit of independent advice.
- There has been full and frank financial disclosure.
- The agreement has been entered into freely and without duress (at least 21 days before the Marriage or Civil Partnership ceremony is recommended).
